LIVIT EXPERIENCE GENERAL TERMS & CONDITIONS
Livit Experiences ltd are committed to your enjoyment of the experiences we offer. We want you to feel welcome at our events, whilst offering a safe and controlled environment for you chosen experience. We would like to ensure there are no misunderstandings that could detract from your enjoyment and therefore, recommend that you take time to read these terms and conditions in full before you purchase one of our experiences.
Delivery – Vouchers/gift boxes ordered before 3pm will be posted out that day (Monday-Friday). If a voucher/gift box is ordered after 3pm it will be sent out the following morning. Please be aware that if you choose for your order to be sent via Royal Mail 1st class, it can take up to 5 working days. In all delivery cases Livit Experiences cannot be held responsible for failure of delivery or loss. There is no dispatch on weekends or UK bank holidays.
Refunds – We will refund un-booked experiences within 7 days of purchase minus a 10% administration fee. If you have booked a date within this 7 day period, then no refunds are allowed. After 7 days no refund will be available. Refunds are always made to the person who purchased the experience and, if originally purchased by credit/debit card, the refund will be credited to the same card. If the card has expired you will need to request a refund in writing, quoting details of the new card. If you have purchased a date specific voucher, no refunds will be available.
Lost Vouchers - These can be re-ordered after sufficient proof of purchase, at an administration fee of £15.
Booking Your Experience – Any experience date is only open and therefore available for booking 12 weeks prior to the date. All bookings are taken on a first come, first served basis. We operate on selected weekdays and weekends (NOT EVERYDAY) throughout the year depending on the type of experience bought. For Driving Experiences our season runs from March to November. All vouchers are valid for 12 months from the purchase date. You must use your voucher before it expires. If the dates your require are full you may loose your voucher. Please note you can only extend your voucher once. Once your are booked into an experience date we reserve a specific time slot for you. Changes to a booking, including date and/or name changes can ONLY be made 30 days before the event and an administration fee of £25 will be charged. We are unable to make provisional reservations. When you book a date it will be confirmed to you
by email. You are advised not to make travel, hotel or any other arrangements until you have received your confirmation email. In the event that circumstances beyond our control mean that we have to change any part of your experience Livit Experiences cannot be held liable for any expenses incurred by you. Please allow enough time for your journey. If you arrive later than the sign in time stated on your confirmation, you will forfeit part or all of your experience. No refunds will be given. Directions to the venue are for assistance only so please plan your journey carefully. Livit Experiences are not responsible for customers’ arrival at the venue. All booking requests made by email will be processed within 24 hours of receipt during weekdays only.
Spectators – Are welcome at most of our experience events, however your are advised to check specific details when booking your experience as conditions may apply for some venues and experiences. In most cases spectators can Pay & Play on the day if there is availability, but this will be subject to the same conditions as pre booked experiences. No dogs are allowed at any of our venues with the exception of Guide dogs.
Driving Licences – For driving experiences including off road 4x4 experiences the driver must hold a full UK driving licence. There is no minimum age, but drivers must have held their full licence for at least 6 months. For information on validity of EU or any other driving permits please check before purchasing a voucher. You MUST hold a valid licence on the day of your experience. Both parts of the licence need to be produced when you sign in and you may be charged an admin fee if you have forgotten to bring it. If you have booked a passenger or hot lap no licence is required.
Other Restrictions - In all of our vehicles, the general height we can accommodate is 4ft 8” to 6ft 8”. There are no weight or age restrictions other than those linked to relevant driving licences as above. If you are unsure about any aspect of size or weight concerning the experience you would like to purchase, please discuss it with our sales staff or customer services team before you purchase. If you have any medical condition or disability that could affect your ability to undertake the experience, this must be discussed before purchase by calling our office. If you are in doubt then please consult your doctor.
Arrival and Sign in – Once you have received your booking confirmation email you must sign in at the venue by your allotted time (usually 45 minutes before your experiences start time). If you are late for your sign in you may miss part or all of your experience. Please see your booking conformation for details. You must bring your gift/experience voucher, your booking confirmation and driving licence where applicable. Failure to do so will incur an administration charge of £10 for each part. All participants must sign an indemnity form on arrival at the venue. “I agree to keep indemnified Livit Experiences, their officials, servants, representatives or agents, the land and any other persons using the facility, from and against all actions, claims or damage to the property, myself or others at the venue, however caused. I also confirm to pay up to £2000 of any damage I cause due to being reckless, careless or negligent. I confirm that I am not suffering from any illness or
disability whether permanent or temporary that is likely to affect my control while carrying out my experience”.
Session lengths/laps are approximate and vary from venue to venue. They are given as an indication of the time you will spend at the venue. Unless stated otherwise, you will usually be taking turns with other people and there will be waiting time involved. We give timed itineraries as a guide only and the running order of an event may change without notice. Circumstances beyond our control may mean that venues change from time to time, Livit Experiences will endeavour to give as much notice as possible if this occurs. Livit Experiences will not be liable for any such changes.
Clothing – You are advised to wear comfortable shoes and suitable clothing. Be aware if you are taking part in driving experiences that pedal spacing in supercars is very close therefore narrow shoes are recommended. On cold days both the driver and spectators will need warm, waterproof clothing, gloves, hats etc. We recommend you bring a warm jumper even in summer months, as it can get very windy at some of our event locations. Sun protection is recommended on hot days. Please be aware that wearers of contact lenses may experience some discomfort from dust on dry days. It is advised to check any more experience specific clothing requirements when booking in for your experience day.
Cancellation Cover – Is a available at a premium of £20, this cover can be purchased as an option when purchasing the experience, booking the date of your experience or at any time up to 7 days prior to the event. This covers you for instances such as illness or death in the family prior to your booked event or break down on-route, the cover will allow the re-booking of the activity within 6 months of the booked date. Relevant documentation must be provided in the event of cancellation.
Insurance - With few exceptions, all our experiences involve some element of risk and danger. This is what creates the excitement and the thrill. Every customer is covered by our standard public liability insurance. You may wish to take out additional cover over and above that provided. Accordingly you are advised to consider insurance cover for personal accident, loss of limb and even death or indemnity insurance for damage caused to any vehicles or machinery on your event before embarking on your experience. To ensure the validity of any insurance cover we may in some instances ask clients over a certain age to produce a medical certificate. If you wish to arrange your own additional cover please bring the policy document with you. Once booked you may be liable for charges if you have to cancel because the requirements are not met. Livit Experiences is not responsible for any risks not specifically covered by its own insurance and on arrival at your venue for an experience you
will be asked to sign an indemnity as covered in INDEMNITY below.
Withdrawal of experiences, descriptions, and or locations - Gift vouchers can range in price from £20.00 and above and are valid for all the experiences shown on our web-site. If an experience has been withdrawn the recipient will be advised and offered an alternative as near as possible to the original. If this should prove to be impossible you will be offered an alternative with assistance from the customer service team, subject to payment or refund of any difference in price. If alternatives have been offered and dates are available no refunds will be available.
Mechanical Failure – Although all vehicles used for our experiences are meticulously maintained, mechanical failures do occur from time to time. For Driving Experiences the supercars we offer are unique high performance vehicles and as such can be difficult to replace if a mechanical failure occurs on an event day. Livit Experiences will always use its best endeavours to replace any vehicle that is not drivable, but where this is not possible you will be offered an alternate vehicle to drive. If there is no alternate vehicle available you will be issued a voucher to complete your experience at another time.
Cancellation of your booked event due to adverse weather conditions or mechanical breakdown. From time to time some of our experiences may have to be cancelled or suspended due to adverse weather conditions, reasons beyond our control, or very occasionally mechanical breakdowns. Wherever possible, for example in the case of breakdown of the vehicle, every effort will then be made to contact you and or offer an alternative on the day or re-book the experience at the next available date and venue. Generally, weather forecasts are sufficiently unreliable to make any definitive decision the day prior to an event and as such, bad or unpromising forecasts the day before your event is NOT an acceptable reason for you to want to cancel your drive. Non-attendance on a day that operates in spite of bad weather forecasts will mean you loose your experience completely. If your driving is cut short because of bad weather, you will be able to return on another day to complete the balance of your experience. Refunds will not be given. Livit Experiences will not be responsible for any accommodation, travel or incidental expenses incurred by customers and every effort will be made on the day for your event to continue.
Complaints procedure – Any problems or complaints on an event day must be brought to the attention of the event manager/organiser at the venue as soon as possible and every effort will be made to rectify the situation. Please note that is difficult to put things right after you have left the venue and refunds will not be issued after the event. For all other matters please send a letter or email to the address on our “contact us” page for the attention of the Customer Services Manager and we will aim to reply within 7 days.
Indemnity – All customer at an event must agree to keep indemnified Livit experiences, their officials, servants, representatives or agents, the owners of the land and other persons using the facility, from and against, claims, costs and expenses and demands in respect of death and bodily injury to the property or yourself or your passenger however caused, arising out of or in connection with participation in practice and not withstanding that same may have been contributed to or occasioned by negligence of said bodies, persons, their officials and servants, representatives or agents.
Definitions and general information – The images used in all promotional material are for illustration only and may differ from the actual experience, particularly those that take place at more than one location. The machines, vehicles, crafts and settings at each venue may vary and are subject to availability and/or change. In some instances, the duration of the experience could be influenced by weather, the number of persons participating on the day and as a consequence some waiting time may result. The images used and descriptions of duration and availability of experiences on the website are intended to be a guide for clients and do not form any part of any contract with them. The equipment used, the settings in which they take place, as well as the supplier/venue may vary from time to time and are subject to change without notice to us. Livit experiences reserves the right to make amendments and changes to their experiences without notice and will not be liable for doing so. H owever, all reasonable steps are taken to ensure that the experiences provided fall within the general terms as described in the description on the website. If for any reason this cannot be fulfilled alternative venues or experiences will be offered to the value of your voucher.
Prices are correct at the time of publication, but the company reserves the right to increase/decrease prices at its discretion. However where such price increases are made clients will be notified before placing an order. Gift vouchers will only be issued after payment has been made in full to the company.
Office opening times – Livit Experiences reserve the right to alter published opening time from time to time, and on event days answer machine messages will indicate emergency mobile numbers on which staff can be reached. Any messages left on event days will be dealt with on the next working day.
Data protection act 1998. All details supplied by clients or recipients of gifts remain confidential to the company. Under no circumstances will any information be supplied to third parties without our clients and or the recipient’s specific authorities in writing, except where there is an emergency involving the statutory authorities. We may use this information for marketing purposes to send you information an offers from time to time, if you do not wish to receive this please make sure you have checked to relevant option when booking.
All illustrations, pictures and text used by Livit Experiences are protected by copyright and must not be copied in whole or in part without our permission.
All the above terms and conditions apply as a condition of using any voucher, whether or not the voucher holder is the original purchaser. The above terms and conditions are to be interpreted in accordance with the laws of England and Wales and the statutory rights afforded there under and subject there to form the basis of the contract between the company and its corporate or individual client.
Livit Experiences liability for any claim of breach of obligation regarding any single voucher or experience shall not exceed the price of that experience. This excludes claims arising from personal injury or death due to proven negligence of anyone for whom we are responsible.
We have a strict no smoking policy whilst in and around the vehicles and inside any buildings. Alcohol and drugs are strictly forbidden from our events. Anyone who is considered to be under the influence of alcohol or drugs will be excluded from all activities and no refund or rebooking will be offered.
